As an authorized affiliate (Affiliate) of Talk to Fred, you agree to this Affiliate Terms of Use Agreement (Agreement). Please read it before registering for or promoting the Talk to Fred Affiliate Program (Program).
Your participation in the Program is for referring prospective customers to Talk to Fred through your own website, content, or personal referrals. By applying for the Program, you accept this Agreement.
Approval or Rejection of the Application
We may approve or reject an Affiliate Program application at our sole discretion.
Commissions
The published affiliate commission rate is 20% of eligible referred purchases made through Talk to Fred checkout. Eligible purchases currently include recurring payments for Fred Cloud, Fred Cloud Pro, and Fred Everywhere, plus the one-time white-glove installation SKU.
At current list prices, 20% equals $59.40 for each eligible $297 Fred Cloud payment, $79.40 for each eligible $397 Fred Cloud Pro payment, $20 for each eligible $100 Fred Everywhere payment, and $400 for an eligible $2,000 white-glove installation purchase. Prices and resulting commission amounts may change; the 20% rate applies to the eligible amount actually paid by the referred customer, excluding taxes, credits, refunds, chargebacks, and noncommissionable amounts.
Recurring commission is payable while the referred subscription and the Affiliate account remain active and in good standing. Commissions are paid monthly. The referred account must remain active for at least 31 days before commission becomes payable.
You cannot refer yourself or receive commission on your own accounts. Affiliate commission does not apply to sell-through partner, reseller, wholesale, internal, complimentary, or otherwise discounted partner purchases and cannot be stacked with partner pricing.
Payments are sent only for successfully completed, tracked, and eligible transactions. Transactions resulting in refunds, cancellations, fraud, or chargebacks are not payable and may be reversed.
Earnings Disclaimer
Any commission examples are illustrations only. Results depend on eligible referrals, purchases, renewals, refunds, account status, and other factors. No earnings are guaranteed or typical.
Termination
Your application or Program participation may be suspended or terminated for reasons including:
- False or misleading advertisements, hyperlinks, product claims, or earnings claims.
- Spam or other unlawful or unsolicited promotion.
- Advertising on sites containing or promoting illegal activities.
- Failure to make required affiliate or endorsement disclosures under Federal Trade Commission guidance or applicable law.
- Violation of intellectual-property rights.
- Unauthorized rebates, coupons, or kickbacks funded from commission.
- Self-referrals, fraudulent transactions, suspected fraud, or attempts to combine affiliate and partner pricing.
Talk to Fred may terminate an Affiliate account for a violation of this Agreement.
Affiliate Links
You may use approved graphic and text links on your website, in email messages, and in lawful online or offline advertising. You may create your own materials if they are accurate, appropriately disclosed, and consistent with this Agreement.
Coupon and Deal Sites
You may promote only coupons specifically assigned or approved for you. You may not imply that an unauthorized discount exists, bid on Talk to Fred coupon or discount terms, or set an affiliate cookie without a visitor taking a clear action on an accurately labeled offer.
Pay Per Click Policy
Pay-per-click bidding is not allowed without prior written permission.
Liability
Talk to Fred is not liable for indirect or incidental losses arising from tracking failures, interruptions, errors, or Program operation. We do not warrant that the Program or website will operate without interruption or error.
Term and Changes
This Agreement begins when you are accepted into the Program and ends when your Affiliate account is terminated. We may modify the Agreement and will make the current version available on this page. Continuing to participate after a change constitutes acceptance of the revised Agreement.
Indemnification
Affiliate will indemnify and hold harmless Talk to Fred and its affiliated companies, officers, directors, employees, licensees, successors, and assigns from claims, damages, fines, judgments, costs, and reasonable legal expenses arising from Affiliate negligence, misrepresentation, failure to disclose, violation of this Agreement, or intentional misconduct.
Electronic Signatures
This Agreement is an electronic contract. Completing the Affiliate application process creates an electronic signature with the same force and effect as a handwritten signature.
